Fitness Factory KC – Terms and Conditions

1. Acceptance of Terms

1.1

By accessing or using Fitness Factory KC’s facilities, located at our Overland Park, KS location, you agree to be bound by these Terms and Conditions. These terms govern your use of our 24-hour gym facility and services.

1.2 Communication Consent

By consenting below, you agree to receive communications from Fitness Factory KC regarding your account, services, and occasional marketing via SMS/text message, email, and voice calls.

  • Voice & Automated Calling Consent: You expressly consent to receive calls, including those made using an artificial or prerecorded voice and Voice AI technology, to the number provided. You agree that an Automatic Telephone Dialing System (ATDS) may be used. Your consent to receive calls is not a condition of purchase.

  • SMS/Text Consent: You consent to receive SMS notifications and alerts. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe from text messages at any time.

2. Membership

2.1 Membership Types

  • Monthly membership (Full Access)

  • Annual membership (Full Access)

  • Off-Peak membership (Restricted Access)

  • Day pass options

2.2 Membership Agreement

  • Members must be 18 years or older or accompanied by a guardian.

  • Membership is non-transferable.

  • Photo ID and access card (Facilikey) are required for entry.

3. Access and Entry

3.1 Facilikey Access

  • Each member receives a unique Facilikey access account.

  • Loss of access must be reported immediately.

  • Unauthorized sharing of access card is grounds for membership termination.

3.2 24-Hour Access

  • Standard Monthly and Annual members have 24/7 access to the facility.

  • Access may be temporarily restricted for maintenance or emergencies.

3.3 Off-Peak Access Restrictions

  • Off-Peak memberships are restricted to specific hours. Access outside of these designated times is not permitted and may result in additional charges or membership reclassification.

  • Current Off-Peak hours are posted at the facility and on our website; Fitness Factory KC reserves the right to adjust these hours with 30 days’ notice.

4. Facility Rules

4.1 General Conduct

  • Maintain cleanliness and return equipment to designated areas.

  • Wipe down equipment after use.

  • Use appropriate workout attire.

  • No aggressive or disruptive behavior.

  • No smoking, alcohol, or illegal substances permitted.

4.2 Equipment Usage

  • Use equipment as intended.

  • Report damaged equipment to staff.

  • Maximum workout time of 90 minutes during peak hours.

5. Safety and Liability

5.1 Health Disclaimer

  • Members participate in physical activities at their own risk.

  • Consult a physician before starting any exercise program.

  • Fitness Factory KC is not liable for personal injuries.

5.2 Personal Belongings

  • Lockers are available for temporary storage.

  • Fitness Factory KC is not responsible for lost or stolen items.

6. Payment and Billing

6.1 Membership Fees

  • Payments are due on the same day of sign up for each month.

  • Late payment fee of $25 after 5-day grace period.

  • Accepted payment methods: Credit/Debit Card, ACH Bank Transfer.

6.2 Cancellation and Refunds

  • 30-day written notice required for month-to-month membership cancellation or end of your 1-3 Year contract agreement.

  • No refunds.

  • Membership can be paused once per year for up to 30 days.

  • Cancellations can be made online or in-person. Reference the Cancellation Policy for more detailed information.

7. Privacy and Data

7.1 Personal Information

  • We collect personal information for membership management.

  • Information is handled in compliance with Kansas privacy laws.

  • Members can request data deletion at any time.

8. Termination of Membership

Fitness Factory KC reserves the right to terminate membership for:

  • Violation of terms and conditions.

  • Inappropriate behavior.

  • Non-payment.

  • Misuse of facilities or equipment.

9. COVID-19 Precautions

  • Follow current local health guidelines.

  • Practice social distancing when possible.

  • Use provided sanitization stations.

  • Stay home if experiencing symptoms.

10. Changes to Terms

Fitness Factory KC may update these terms periodically. Current version will always be available at the front desk and on our website.
